Terms of Service

1. Agreement to Terms

By accessing or using Pulley ("the Service"), operated by Black Hills Works LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Pulley is a CRM and engagement platform designed for small nonprofits. The Service includes contact management, donation tracking, volunteer coordination, email outreach, reporting, and related features accessible at app.getpulley.app.

3. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One organization account may have multiple team members with different roles (admin, member).
• You must notify us immediately of any unauthorized use of your account.

4. Your Data

You retain ownership of all data you upload or create within the Service, including contacts, donations, volunteer records, and organization information. We do not claim ownership of your data.

You grant us a limited license to store, process, and display your data solely to provide the Service to you. This includes sending your data to third-party services as described in our Privacy Policy (e.g., Stripe for payments, Gmail API for sending emails you initiate, Anthropic for AI draft generation).

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, unsolicited bulk email, or deceptive messages through the Service
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the Service without written permission
• Use the Service in a way that violates the rights of your contacts or donors
• Exceed reasonable usage limits that degrade the Service for other users

6. Gmail Integration

If you connect your Gmail account to the Service, you authorize Pulley to send emails on your behalf using the Gmail API. Emails are only sent when you explicitly initiate them through the Service. You are responsible for the content of emails sent through your connected Gmail account. You may disconnect your Gmail account at any time.

7. AI-Generated Content

The Service uses artificial intelligence to generate email draft suggestions. AI-generated content is provided as a starting point and may require editing. You are responsible for reviewing and approving all content before it is sent. We do not guarantee the accuracy, appropriateness, or quality of AI-generated drafts.

8. Payments and Billing

• Subscription fees are billed monthly through Stripe.
• All fees are non-refundable except as required by law.
• We may change pricing with 30 days' notice. Existing subscribers retain their current rate until the end of their billing cycle.
• If payment fails, we may suspend access to the Service after a reasonable grace period.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss.

10. Termination

You may cancel your account at any time from your Settings page or by contacting us. We may suspend or terminate your account if you violate these Terms. Upon cancellation, your data is retained for 30 days to allow for reactivation or export, after which it may be permanently deleted.

11. Limitation of Liability

To the maximum extent permitted by law, Pulley and Black Hills Works LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of South Dakota, without regard to conflict of law principles.
